§ 406. Utilities.

  • Subdivisions to be serviced by well and/or septic systems may receive final plat approval prior to health department approval of individual on-site well and septic systems, provided the developer makes application with the Halifax County Health Department for improvement permits and/or well permits for all lots within the subdivision. Approval of the final plat is for recordation purposes only and does not obligate Halifax County to issue permits for construction on each lot. A soils report from a North Carolina Licensed Soil Scientist is strongly recommended to advise the developer on the suitability of lots. Alternate private water supply and wastewater disposal systems, including community water, package wastewater treatment plants, and community spray irrigation wastewater disposal systems shall be permitted by the North Carolina Division of Environmental Management prior to review and approval of the final plat.

    Extension of public water to proposed subdivisions is required when county water is adjacent to the subdivision property. Extension of public sewer to proposed subdivisions is encouraged as feasible. Such extensions shall be provided at the expense of the subdivider and shall conform with the policies and standards of the Halifax County Water Department and the North Carolina Division of Environmental Management, as applicable. The public utility shall approve the concept of the extension prior to review and approval of the preliminary plat. The county planning board with the board of county commissioners approval may require that a subdivider install utilities to serve an area larger than the proposed subdivision in order to provide orderly development of the utility system. However, in such a case, the county will pay any additional costs incurred for oversized lines.

    406.1  Stormwater drainage: The subdivider shall provide a surface water drainage system constructed to the North Carolina Department of Transportation standards, to comply with the North Carolina Sedimentation Pollution Control Act, and to comply with the following guidelines:

    (a)

    No surface water shall be directed into a sanitary sewer.

    (b)

    Surface drainage courses shall be sized to accommodate the runoff from the drainage area. The county may require the dedication of stormwater easements.

    (c)

    In areas of special flood hazards, all subdivisions shall have adequate drainage provided to minimize exposure to flood damage. A flood study by a registered engineer to determine the elevations and boundaries of the floodway and floodway fringe areas may be required by the county planning board.
