§ 14-122. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Animal waste means livestock or poultry excreta or a mixture of excreta with feed, bedding, litter or other materials.

    Approved animal waste management plan [WMP] means a plan to properly collect, store, treat and/or apply animal waste to the land in an environmentally safe manner. The best management practice or system of practices which comprise the plan must meet the design, construction, operating and maintenance standards and technical specifications of the U.S. Department of Agriculture-Soil Conservation Service in section IV of the Field Office Technical Guide, or any combination which the county health department deems to provide water quality protection.

    Effective July 25, 1994, an approved plan must also meet the additional applicable specifications and requirements contained in these rules.

    (2)

    Plans are considered approved when they are:

    a.

    Certified by the soil conservation service that the criteria for design and construction are met and that the operation and maintenance criteria can be met; and

    b.

    The Halifax County Health Department certifies that additional requirements contained herein are met.

    The landowner or leasee must submit SCS certification to the county health department on forms supplied by the health department. A new certification must be submitted for each change in land ownership or lease agreement.

    Concentration of animals means the grouping together of animals in a confined area which does not have naturally growing vegetation and in which animal waste collects naturally or must be collected for storage.

    Director means the director of the county health department.

    Expanded animal waste treatment works and disposal/utilization system means existing facilities which require an expansion of the existing waste treatment system design capacity in order to accommodate an increase or proposed increase in waste production.

    Feedlot means a lot or building, or combination of lots and buildings, intended for the confined feeding, breeding, raising or holding of animals and specifically designed as a confinement area in which animal waste may accumulate or where the concentration of animals is such that a vegetation cover cannot be maintained. Pastures shall not be considered feedlots under this rule.

    Groundwater means those waters in the saturated zone of the earth, as defined in 15A NCAC 2L.

    HCHD means Halifax County Health Department.

    Intensive livestock operation (ILO) means any enclosure, pen, feedlot, building or group of buildings intended to be used or actually used to feed, confine, maintain or stable cattle, horses, sheep, goats, turkeys, chickens, swine, or any combination thereof, where their dietary needs are met primarily by means other than grazing.

    Job classification means a system of classifying an ILO according to the volume of animal waste produced. The SCS Field Office Technical Guide (FOTG) section IV as interpreted by SCS will be used to classify all ILOs. See Appendix A, set out following this division, for approximate animal numbers in each classification.

    New animal waste treatment works and disposal/utilization system means facilities which are constructed and operated at the site where no ILO existed previously or where an ILO has been abandoned or unused for a period of two years or more.

    Operation means from the date at which an ILO is populated with animals.

    Permanent waste storage facility means the location used to store animal waste and animal waste by-products for at least six months out of the year.

    Residues from agricultural products and processing means solids, semi-solids or liquid residues from food and beverage processing and handling; silviculture; agriculture; and aquaculture operations that are nontoxic, nonhazardous and contain no domestic wastewater.

    SCS means United States Soil Conservation Service.

    Surface water means all water which is open to the atmosphere and subject to surface runoff.
