§ 30-33. Exceptions.

  • This article shall not apply to the following sound emission sources:

    (1)

    Emergency warning devices or safety signals;

    (2)

    Lawn care equipment, agricultural field equipment and commercial logging equipment;

    (3)

    Equipment being used for construction during daytime hours; provided that, all equipment is operated with all standard equipment, manufacturers mufflers and noise reducing equipment in use and in proper operating condition;

    (4)

    Parades, fairs, circuses, other similar public entertainment, sporting events taking place during daytime hours in areas set aside for the activities, or any activities normally associated with any of the above;

    (5)

    Chimes and similar devices which operate during daytime hours for a duration of no longer than five minutes in any given period;

    (6)

    Emergency work;

    (7)

    Industrial, manufacturing and mining operations so long as such operations are otherwise conducted in accordance with all applicable permits and zoning regulations;

    (8)

    Motor speedway operations between the hours of 7:00 a.m. and 12:00 midnight;

    (9)

    Outdoor amphitheater events so long as such events are otherwise conducted in accordance with all applicable permits and zoning regulations; and

    (10)

    The engine sound emissions of "antique automobiles" as defined by G.S. 105-330.9(a).

    (11)

    Special events or activities under permit issued by the county manager or designee on a case-by-case basis in accordance with section 30-33A.
