§ 3-2.4. Separation; in general.

  • Part-time and/or temporary employees will not be subject to retirement or appeal procedure.

    All separations of employees from positions in the service of Halifax County will be designated as one of the following types and will be accomplished in the manner indicated: resignation, reduction in force, disability, death, retirement, or dismissal.

    Resignation.

    An employee may resign by notifying his department head (or in the case of department heads, the county manager) of the effective date as far in advance as possible, with a minimum of two weeks' notice from all personnel. However, a minimum of 30 days' notice is requested for selected professional employees as designated by the department head.

    Final salary and earned leave payments.

    If a person leaves after the 1st of the month, but before the 10th, they will be paid on the 15th.

    If a person leaves after the 10th of the month, but before the 20th, they will be paid on the 25th.

    If a person leaves county employment after the 25th of the month, but before the 1st of the next month, the finance officer must be notified to hold their check and not pay them on the 25th. After all paperwork is completed, including a final time sheet, the person will be paid in full within five working days.

    The department/agency head must have the necessary time sheets and other paperwork, including accumulated vacation leave, in to the finance office the next working day after the person leaves.

    Accumulated vacation pay will be paid in a separate check, other than salary check. All regular deductions will be made from accumulated vacation pay. If accumulated vacation pay is not enough to offset any overpayment, the employee must refund the overpayment, otherwise their retirement refund or payments will be held up until their account is settled.

    All departing employees must turn in any and all assigned equipment, and the department/agency head must certify receipt of equipment before the final payment can be processed. (Assigned equipment includes radios, beepers, car or truck keys, building keys, credit cards, etc.)

    Reduction in force.

    In the event that a reduction in force becomes necessary, consideration will be given to the quality of each employee's past performance, the need for his service, and seniority in determining those employees to be retained.

    Employees who are to be laid off because of reduction in force will be given at least one pay period notice of anticipated lay-off.

    The duties performed by any employee laid off may be reassigned to other employees already working who hold positions in the appropriate classes. No permanent employee will be laid off while another person is employed on a part-time or temporary basis in the same class.

    Disability.

    An employee may be separated for disability when he cannot perform the required duties because of a physical or mental impairment. Action may be initiated by the employee or the county, but in all cases it must be supported by medical evidence as certified by a competent physician. The county may require an examination at its expense and performed by a physician of its choice. Before the employee is separated for disability, a reasonable effort shall be made to locate alternative positions within the county's service for which the employee may be suited.

    Death.

    Separation will be effective as of the date of the death.

    All compensation due in accordance with section 6 of this policy will be paid to the estate of the employee.

    Retirement.

    Whenever an employee meets the conditions set forth under the provisions of any retirement plans adopted by the commissioners for county employees, he may elect to retire and receive all benefits earned under the retirement plan.

    Medical coverage for retirees.

    Halifax County will provide, at it's expense, medical insurance (hospitalization) for all employees who retire with at least 30 years' service, of which, the last 20 years is service with Halifax County. Coverage will cease when the retiree reaches 65 years of age and is eligible for medicare.

    Dental coverage will not be offered to retirees.

    This policy will be evaluated on a yearly basis.

    This policy is not retroactive.
