§ 14-134. Suspension or revocation of operations permits.

(a)

Failure to maintain a treatment works and disposal/utilization system for animal waste as permitted or violation of any condition of the operations permit may result in suspension or revocation of the operations permit. Prior to suspension or revocation action, the permit holder shall receive written notice from the HCHD of the violation and be allowed 30 days to correct it, unless the violation poses an immediate threat to public health or safety.

(b)

Revocation of an operations permit shall take place only after:

(1)

A finding by the HCHD that a violation of the operations permit was willful; or

(2)

The permit holder has received three separate permit suspensions within a 24-month period; or

(3)

The permit holder or land owner fails to allow an inspection pursuant to section 14-135.
